Agreement to These Terms

These Terms of Service govern access to and use of Tryout Evaluator by coaches, evaluators, staff, clubs, teams, and other organizations that use the service. By creating an account, accessing the service, or using the service on behalf of an organization, you agree to these terms.

If you use the service for an organization, you represent that you have authority to bind that organization to these terms.

Who May Use the Service

Tryout Evaluator is intended for adults acting on behalf of teams, clubs, schools, and similar organizations. You may use the service only in compliance with applicable law and only for legitimate evaluation, organizational, and roster-related purposes.

Accounts and Organization Access

• You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.
• Your organization is responsible for deciding who receives access and what information those users may enter, review, or export.
• We may suspend or limit access to protect the service, investigate misuse, address security issues, or comply with law.

Acceptable Use

You may not use the service to interfere with its normal operation, attempt unauthorized access, upload malicious code, misuse another organization's data, or use the service in a way that violates law, privacy rights, or contractual obligations.

Customer Data and Service Use

You retain responsibility for the player information, notes, rankings, and other content you or your organization enter into the service. You grant us a limited right to host, process, transmit, back up, and display that information only as needed to operate, secure, support, and improve the service.

You are responsible for ensuring that you have the right to enter and use the information you place in the service.

Service Availability and Operational Risk

Tryout Evaluator is designed to support live evaluation workflows, but we do not promise that the service will always be available, uninterrupted, timely, secure, current, or error-free. Outages, software defects, synchronization delays, browser issues, device failures, connectivity problems, third-party service interruptions, and user mistakes can occur at any time.

Because the service may be used during live and time-sensitive events, including tryout day, follow-up evaluation sessions, roster meetings, and other decision periods, you are responsible for maintaining your own backup process and for using independent judgment rather than relying on the service as your only source of evaluation records or roster decisions.

Disclaimers

To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the service will meet your needs or produce any particular evaluation, roster, or business outcome.

Limitation of Liability

To the maximum extent permitted by applicable law, Tryout Evaluator and its operators, owners, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of records, loss of business, loss of revenue, loss of goodwill, missed opportunities, or other harm arising out of or related to your use of, inability to use, or reliance on the service.

This limitation applies whether the issue arises during tryout day or at any other time, and includes claims based on outages, bugs, synchronization failures, delays, inaccurate or incomplete information display, account-access problems, connectivity issues, third-party platform failures, or any interruption of service.

If applicable law does not allow certain liability exclusions, those exclusions apply only to the maximum extent permitted by law.

Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these terms, create security risk, fail to pay required fees, or use the service in a way that could harm the platform or other users.

Changes to the Service or Terms

We may update the service and these terms from time to time. When we update these terms, we will revise the "Last updated" date on this page. Continued use of the service after updated terms become effective means you accept the revised terms.
